Statement by AGB President Richard D. Legon on the Release of the U.S. Department of Education’s Proposed Regulations on Title IX and Campus Sexual Assault

Given the importance of this issue, the inherent complexity of many sexual misconduct cases, and the diverse legal obligations under which institutions operate, AGB members will study this proposed regulatory language to determine how it will impact campus policies that enable colleges and universities to best support students on campus. AGB plans to be a part of this upcoming review and discussion to ensure the best results for institutions and, most importantly, for students.

The oversight of policies to address sexual misconduct on campus fall under the most basic responsibilities of college and university governing boards—therefore, board members will review this new Education Department guidance with intense scrutiny. Board members recognize that ensuring a safe and supportive learning environment is fundamental to the makeup of a higher education institutions, and over the last several years our members have made strides in advancing priorities like promoting student mental and physical health, supporting survivors, and establishing appropriate disciplinary processes.
